I don't see how they could have any authority to do that as long as no one was involved in doing a ''run'' of them or something like that. Maybe I'm being naive though...
 
Well it didn't look like he was making them, just selling one that he already owned.

Someone is still profiting off of their trademarked icon. That's illegal, and they leave no room for a grey area...like most of the fabulous people who allow us nerds to quietly replicate and sell their designs here.

They've come down on people just for OWNING a replica statuette. So something tells me they won't give the winner of that auction any option besides shipping the replica to them or destroying it outright.

It really is a shame they can't just let us fans have fun.

Trust me they have all the authority they need.

They vigorously enforce their copyright of Oscar and have done so in the past.

I recall someone just "having" a replica in their collection, and it showed in the background of a photo they posted on their website.
They were contacted and had to destroy the piece and ship the cut up pieces to the academy as proof.
So they tend to crack down even if you are not selling them.

Well, I know that's about what happened with the replica I HAD (as explained earlier in this thread in case anyone form the Academy is looking). I had taken a picture of a couple replica I was painting for someone and they got me through that SINGLE picture. The saddest part is that I never posted the picture publicly - it was just hosted on my own server to show someone privately and I forgot to take it off.

Cut to a few years later, a few RPF members with an axe to grind sent the picture and server location to the Academy. They knew it was there because they had cleaned out my open server a few months/years before. I recieved the C&D just a few days after my server logs showed access to the picture (from the members via their IP addresses) and the access of the picture by the academy's legal firm (also by IP address). Whoops ;)

Like I said before - it's one of the few things in this this hobby you just DO NOT mess with or even think about messing with.
 
You made mold by yourself? There are still oscars out made from plastic sold in stores in the 80s and 90s, which are casted and these casts were sold from time to time... But they look bad...

Of course the academy has every right on these oscar stuff, I just wonder if they have any legal basics for international actions...

With our burgeois exactly laws, I guess they have to prove that someone owns one...

I guess, even if someone would own one, he better take care that this thing officially is owned by this other guy... ;)

I don' want to make any trouble and I'm sorry if I don't show the seriousness this topic brings with...

I just asked myself, what so special about the golden guy and why the copyright is more rigorous than others... I am very interested in laws and especially these prop topics in combination with copyright and laws are always interested for me...

If I pushed my finger to deep in the hornet's nest, feel free to delete my posts or edit them...
