    Well this is going to change a lot of things but I don't really think the companies will go after cosplayers for making costumes to wear to conventions or Halloween parties. The fact people are making these props/costumes actually supports the popularity of their products in the worldwide consciousness. I understand the concept of making a Batmobile for resale over and over again as a business being a copyright violation but making a one off for yourself shouldn't be a problem.
