It depends on how you paid really. It is kind of a gray area, because intentionally buying a "counterfeit" is illegal in the US. This is why these items get seized if customs stumbles upon the package and opens it up.
If paid with paypal, I believe you have something like 45 days to open a dispute. If you BANK WIRED money to them, you are screwed. There is no way to reverse a bank wire and there is no protection whatsoever because you knowingly submitted the wire and signed off on it. Same goes if you sent them money by Western Union or Money Gram, which a lot of the Chinese factories like to use. If you paid by card, contact your issuer and file a claim. This is if all else fails of course and the vendor doesn't issue you a refund to begin with.
I wouldn't state you were trying to buy counterfeit Nike's, but just being vague "I didn't get my shoes and can't get in touch with the vendor" would be alright.
