Your theory is that the suit is Detroit Steel, and your reasoning is "because it can't be Iron Patriot because Civil War and Normal Osborn". That's not exactly rock solid.

Yeah Kevin I totally agree.
My guess is the USAF repaints the suit in reaction to the public support of Captain America after Avengers. They want their own stars-and-stripes mascot.
I also think it's a completely new suit, and not simply a repaint of the Mk 2 / Variable Threat Response Battlesuit from IM 2, given how similar a lot of the components are (especially the helmet) to the new Mk 8.

My "Theory"
Detroit Steel-
made by Hammer Industries, Sasha Hammer (movie version maybe made by A.I.M)
controlled by cybernetic link (movie MK47 seems to be controlled by cybernetic link)
one of the characters in the "Extremis" story arc.
Sasha Hammer - daughter of the Mandarin (Mandarin's daughter could be in the movie and not as Sasha Hammer)
Sold to the military hence its Stars and Stripes paint job.
Scenes with Detroit Steel seems to be being auctioned off in an A.I.M. set in Florida was just shot a few weeks ago. And oh, a clip from the comics which maybe similar to what was shot in the A.I.M. set.

Oh sure you do. That's why your only concept of the Iron Patriot is stars and stripes paint job, suit looking like Tony Stark's and the name being trademarked by Disney.
