ANOVOS issues (ANOVOS ONLY discussion)

Umm... this should not have been posted and should be taken down. It clearly says that in the CONFIDENTIAL warning...
I mean I can certainly take it down if you guys want... I wasn’t the one who posted it to Facebook though so it’s pretty much out in the wild already regardless of the confidentiality clause. Not even involved in the lawsuit for that matter. Just figured the folks here have as much right to have updated info as anyone

So you are right. It is already in the public domain due to Facebook. HOWEVER, it should not have posted there either without permission. That person violated terms of agreement in the email, and by proxy so does your post. Its says so in the CONFIDENTIAL notice.

No one has a right to CONFIDENTIAL information. Imagine if this was your litigation, and someone posting a letter like this damages your side... im not saying it is in this case, but posting something that says CONFIDENTIAL is in violation.

Maybe the poster on Facebook got permission.... you should double check with them. I also don't know what info is publically available due to court filings.

I think this is the second time a post like this has been done here. Its odd nothing was done before in that case either. The RPF could get in trouble for that ... maybe not.

Its great info and easily something to ask the lawyers what can be shared in the community who may be able to help, but im just saying that posting the email violates the CONFIDENTIAL terms clearly stated on the email.

As I understand it they already have examples of such correspondence but want even more to show patterns or something.

The email and facebook post in question was sent to me directly as a participant and states the following:

Therefore, we ask that if you have corresponded with any of these three entities (Disney LFL, CBS, NBC) concerning your Anovos products, shipping, refunds, or lack thereof, please provide us with any such correspondences including: emails, letters, contact information, any representations or responses given, etc.

I am certain that Disney knew of Anovos crap a LONG time ago but, in a court of law, that has to be shown/ proven.

PLEASE submit any such materials.

Um no... the entire email is confidential.

The email is asking you (the current client) for any communication ... it is not an open call nor recruitment for help. As they stated earlier they are not taking any new clients at this time, and ive not seen any changes to that.

Please let me stress:
I know everyone here is trying to be open and transparent and helpful, but please be careful what you post. Im not trying to be a killjoy, i just dont want people getting themselves in trouble.

I have no legal expertise but it was an open call. Maybe not to share or repost, but definitely an open call.
They also asked me to send whatever information I had and emails even though I am not a client or making a claim and thanked me for what I had which was basically nothing.
 
All, i did clarify with the legal team this is okay to share, and that the latest one is an open question/request for information for those that have interacted with LFL, Disney, CBS, connected to Anovos. They also said it was okay to share the "update emails" so past ones too.

They did update me that they are not taking on additional plantiffs at this time though.

My apologies again if I came off as a killjoy... just trying to be careful.

You're not a killjoy!!! You are being careful and attentive - two things that make you different from Anovos lol.

We would like to again thank you for your involvement and interest in this matter. Your continued participation and document contributions are integral to the progression of this case.

On September 16, 2019, we argued against Defendants Anovos Productions LLC, CBS Studios, Inc., Disney Lucasfilm Ltd., and NBCUniversal Media, LLC’s motion to dismiss this case. To date, the Judge has not issued a decision on this matter. However, the Judge indicated that he wanted us to be more specific with respect to some allegations (provide some more information regarding the manner, time and content of misrepresentations etc.) As a result, the Judge indicated that he is likely to grant Defendants’ motion. However, the Judge also indicated that (with respect to Anovos) we should be able to survive the next motion to dismiss, after we provide the detailed information. However, the Judge also wanted us to be more specific with respect to the Studio Defendants (CBS Studios, Inc., Disney Lucasfilm Ltd., and NBCUniversal Media, LLC). Specifically, the Judge asked us to provide more information as to their knowledge of the complaints by consumers, or similar information that would show that they could also be held liable in this action. Therefore, we ask that if you have corresponded with any of these three entities concerning your Anovos products, shipping, refunds, or lack thereof, please provide us with any such correspondences including: emails, letters, contact information, any representations or responses given, etc.

How long ago did you send it? As per their last reply to me (Aug 20th) they were done, but would ship "some time" after today. They still have 13 days to hit their own word-stretched shipping window.

Still not holding my breath.

Good thing none of us are holding our breath or we would have to change the name of the forum to 'The Blue Man Group'. I know it's lame but it was the best I could come up with.

In 10 days it will be 9 months of waiting since I asked for a refund on an order. Still no end in sight.

Thanks to some rather obvious (in hindsight) stalling tactics by the customer “service” person I received responses from, I am now SOL as far as joining the lawsuit.

(To clarify, I received a response from them, four months after my initial request in January, in which they asked if I reeeeally wanted a refund, or if I’d rather buy something else from them, instead. After confirming that no, they would not be receiving more of my money, they have now gone radio silent.... apart from the series of sales emails they continue to send me from the exact same email address.)

I believe the correct phrase here is: “Buyer beware.”
 
I tried to put this into perspective for someone on the "outside" recently - imagine your grandmother, the one with the trees and bells, pies and roast, lights and angels, all of a sudden doing NOTHING for Christmas. Zero.

She had plans for four years but had to abandon them a couple months out each time.

Maybe she goes to church to hear the singing and have coffee after.

Anyway, it seemed to deliver the point in conversation.

I hate these guys well beyond what would be considered at all appropriate.
 
Jagjaguwar, not sure why you are still waiting for them to give you a refund.
Dispute it with your CC company. If that doesn't work contact Disney, LFL by the emails in this post. I know once Disney, LFL have been contacted the refunds happen really quick.

Not for me... but definitely try Disney. I may try Disney again since Ive heard nothing from Anovos.
 
This means that, IF ANY of us have had correspondence directly with Disney, Lucasfilm, CBS, etc. (anyone listed above) that we send a copy of this correspondence - ESPECIALLY AS FAR BACK AS WE CAN FIND, and supply it to the firm. Myself, I contacted Chris Holm at LFL and Disney directly in September of 2017 and the firm has a copy of that. Chris Holm eventually referred me to Jessica Santin but the opening volley was late September of 2017.

If any of you have any correspondence with them, please send it in. I suspect that what they are trying to determine now is if Disney (in my case) "knew" about the crap going on at Anovos, making them party to fraud. And yes, they knew. We just have to supply proof of that.

That is how I read it and would LOVE to drag Disney down in this matter. They could have stepped in to stop this crap a long time ago.

The ruling I want is that Disney funds completion of all orders and/ or refunds immediately and then dissolves Anovos. THAT would be awesome.

I e-mailed Chris Holm but never received a response... Do I need to send that?
