Ebay seller problems

Hello all,

About a month ago I my girlfriend bought me a Vader helmet on ebay - this particular helmet maker is quite well known around here but not a member of the RPF anymore.
You've probably sussed out who I'm talking about but I'm not naming names right at this minute.
So I paid for the helmet via paypal and was told it would ship in about a week.
I didn't hear a word for about two and a half weeks so I emailed the seller to ask if my item had shipped - no reply.
I had to email another 4 or 5 times asking what the story was before I got a reply.
He said that he'd not been getting my emails and the helmet would ship within a few days - that was on the 24th of August. Then another email on the 29th of August to say my helmet would ship in a few days.
I then got an email to say the helmet was shipping the Tuesday after Labor day.
I emailed to ask if there was a tracking number - no reply again - until the 9th of September to say he had the flu and his wife had shipped the helmet but no mention of a tracking number.
I emailed again to ask about the tracking number to which I got a reply to say he'd get the tracking number off his wife.
Nothing for two days and then today I get 2 emails - one says he's sending it tommorow via USPS (I thought he sent it?) and then a really nutty email that says;

"I said I had the flu...I was down many days I am sorry about that...Now you have the helmet and my money from paypal...You have to reverse the file or I will have to file a full scale claim with paypal since you now have the helmet AND my money..I will also have to file with ebay"


I have no idea what this means - I presume he's mixed me up with someone else.
I have the feeling if I try and get my money from paypal they'll just tell me there's nothing in his account.
What can I do then?
Are there any other ways of getting my money back?

Sounds to me like he's ripping you off and making a case about ripping you off. Paypal, unfortunately, only gives you back $200 per transaction and takes a $25 fee on top of that, if the seller has no funds in his account. The best bet would be to file a claim w/ your cc company to recover the funds completely. I'd do that now, as well as file against him w/ ebay and paypal.

Never presume a seller has mixed you up w/ another, thats what he is probably hoping for in order to extend the transaction date beyond the 45 day paypal limit. You did your part by paying swiftly and timely, he did NOT do his part and has repeatedly lied to you. Cover your a$$ now.

oh. Name names. If he ain't a member here, give it up so everyone else here can avoid this A$$.
 
I would also like to know who exactly who you are referring to...

I know of a guy who also bought a Darth Vader Helmet and was told he'd get it in 2-4 weeks but instead got it in 5 MONTHS..

File your claim before it is too late and let him deal with Paypal and Ebay...You have went WAY beyond what I would have done already.

I could see if he was making the helmet for you and you had to wait for production. Delays and real life intruding are inevitable. But selling something he supposedly already has in his hands and making you wait this long is another matter entirely. He's definitely trying to scam you.

Well after all this I received my tracking number which checks out - I should have my helmet Friday or after the weekend.
Turn outs the seller mixed me up with the person that outbid me (my purchase was a second chance offer) hence the shipped and then not shipped stuff.

So all is good - but thanks for all the advice anyway - I'm happy I didn't need it in the end. ;)

Knowing who it is you are dealing with, I would wait until you have the helmet before you say it's over.

Just because the number checks out doesn't mean its your helmet. Let us know when it arrives.
