Sadly.... these will be two different issues in court. The judge will address them seperately. Your friend will have to pay back the money plus legal fees, and the buyer will most likely be fined for his harrassment and pay fees. If this is a matter of principle to the buyer, he will most likely carry it out just to prove a point and make your friend see the consequences of his actions.

The buyer bought a d-9 gun and that is exactly what he got, there are no refunds through email, he should have bought it while it was still listed on ebay. The only downside to this was my friend having to deal with a 40 year old maniac.
 
Your right he does not own the rights to the gun but the design is slightly different than weta's and he wouldnt be using the term district 9 in the listing name so they really don't have control. It's almost like how china makes replicas or remakes of items just like official items.

I am not 100% sure on that. If I make an item close to a licensed item and just use a different name.... I will still be shut down. It is like the Michael Myers masks. You can call them the shape, or the devil or any other name.... but they still look like him, and they can still go after you. It is stepping on their toes.

But like I said... I am not 100% sure. I am sure there are hundreds of members here who can answer if they would have a case or not.

So I still ask... if you friend hit the gold mine with this contract, why not clear his name and dip into that gold mine and just pay out the refund? It will then be all over. He will have cleared his name and he can then go on collecting the big money for his contract. I mean, if he now has the money, why not make this just go away??
 
And if they aren't, you can bet the person dupped out of their money has already printed this off and will be presenting the posts in court to show the copyright infringement...if not sending the posts to the copyright holder.

My prediction between the threats in emails, the posts, the admitted copyright infringment, and the $220.00 refund....... IT IS GONNA BE UGLY IN COURT!!:lol
He is not breaking the law, the gun inspired him to make a slightly different gun and since the guns are being produced by a big dog such as the guy he is dealing with and if anything is to happen the big dog will be stuck dealing with it.

Don't think for one second that he couldn't be libel for the money because it was done through email.

Craigslist is done through email and phone, and you could potetially sue.

I think the only thing that is in your friends favor were the threats, if true.

Are you sure? Does it say that in a contract? You want to make sure that if the **** hits the fan, the "Big Dog" doesn't bail and leave your friend holding the bag. I would read the fine print.... the "Big Dog" will most likely look out for himself and not agree to take a fall for some small 20 year old prop builder.

Sure he could refund him the money when he gets the money and after bungles repairs the gun and ships it back to him but this contract deal is he gets payed per gun and cranks a few out per week. 220.00 is a large amount to pay for at the moment and only 140.00 of that money was his which ebay just took out so he got nothing out of this whole thing.

There ya go. That is a great solution. Why not have your friend email that idea to the buyer and work it out. Or borrow the money from his parents for the refund, since they know he can repay them with his first order on that contract.

Nope, just letting him know the truth about this hobby. A lot come in thinking that changing things will save you from the studio. It won't.

The buyer waged a war on him, harassed him and threatened him, had the buyer been decent he would have worked something out but this is not the case now bungles has brought this into small claims court and my friend will show the court the call logs and threats, we still dont have any idea of how he got my friends house number.

I think he can get the phone number from the Paypal Transaction page. I believe it shows up on there. You log into your account, and then click on the transcation number and it gives you details of the address, email address, phone number, etc...

Regardless, your friend knew exactly what he had and carefully worded the listing to pass it off as a Quality Arc Gun similar to the ones produced by the actual Weta Team, a description he partially stole from thier website.

quality is a point of view to him and others it was a quality piece he only spent 140.00 on it which was a steal, I believe you left him something nasty first and he returned the fire, he doesnt just post crap on peoples page unless they start it first. Stick up for your maniac 40 year old baby friend all you want he has the threats and harassing calls so when it comes time for court im sure bungles will tell you all about it he started something he shouldn't have in the first place
