Thats really no ones buisness I dont think the seller of the gun would appreciate me giving all of you strangers information about him like this I am only stating what I know about this transaction.


You brought it up. That is why I asked. If it is no ones business, then there is no reason for you to post it.

You know him personally?... I don't buy it. You have too much info on the details, we can figure out that you are the seller and you joined to keep track of things here.

If you refund the money, Ebay would refund you the fees. You get back your selling fees from Ebay.

You can think you know I am him I could care less, I know him as a good friend and he has been talking about this for a few weeks, we are actually making the arc gun out of different materials now like wood and other various items found in hardware stores. This was not done through ebay the money Mr.bungles gave him sat in his paypal account for over a week and ebay deducts their monthly seller fees out of your account whether you like it or not. He payed him through paypal but it was not linked with ebay, he just sent the money.

Now he is trying to sue him in small claims court for this thing in which he will lose, he used the email service instead of ebay, there are no refunds when dealing with things over email and not ebay.

Not true!

It could still be internet fraud if he was sold something that wasn't represented correctly. The judge will decide that.

Well, if this is true.... then good for him.
I am glad hehas some success and came into a situation that he can profit from. That is always a good thing.

And with a budding career in the prop market with this contract, his name and rep is important. So if he has scored some good money with this contract, then why doesn't he just payback the bad sale, and call it over. You clearly made it sound like he has the funds now since you said he hit the gold mine with this opportunity.
The buyer will be happy and his name wil be clear. Then he can go on to fullfill his new contract and bank the cash. Everyone will be happy and the situation closed.

It is great that he got the contract, now that should allow him to make good on the refund.
 
Perhaps he meant resin as fibberglass, as in fiberglass resin.

TBH, I don't see how you got ripped off. Yes, you were expecting a good quality replica, but judging from the description and the pictures, you got exactly what you paid for.

EXACTLY 140.00 was a STEAL for that gun, I sat there for hours watching him make it, watch the youtube video, Mr.bungles claimed it to be broken and misrepresented... He purposely broke that gun to try to give him a bad name, look at his feedback on ebay and yes he meant fiberglass resin, the stuff that smells awful when you open it up out of the metal drum it comes in.

I ship 20 lb fragile items every week from here. I double box them and can ship to Washington State for $28.00. To Alabama, it would be maybe $15.00 for a 20 lb box. In no way does your item weigh that much/

This gun was 36inches long, the box he used was alittle longer than 40inches, he bought a ton of bubble wrap, the box, and to ship it all totaled out over 80.00.

Ahhhhhh. over 40 inches is hit with a surcharge. I do know that is a fact. So, you are probably right... I can see the cost sky rocketing!!
 
You're right, I am sure that was said in anger, but shouldn't have been.

I understand the frustration though. If you aren't happy with the product you should be able to return it.

I think it shows that your friend has crappy business practices.

He waits over a week AFTER he received the gun, the money bungles wired to his paypal account sat in his account for a week until ebay took out their dumb monthly seller fee.
 
TBH, I thought the seller, your friend made it look like that, so it looked war-torn. To the OP, I feel bad for you, because you were expecting a quality replica, however technically, I don't see how you got ripped off. And with the threats, becareful before you post.
 
Yes, while everyone is right about being careful for what you post, especially threats.... you should also be careful what info you post about the sales of the gun.

I wouldn't be throwing word around that he has a "contract" for producing the gun on a weekly basis to sell on websites. Unless he is licensed by the studio to do that, he could be sued for mass production of the item and distribution. He does not own the rights to the gun, as I am sure the owner of the websites does not either. So this can ultimately come back to bite the seller when this goes to court, and a lawsuit is presented by the owners.

And I am pretty sure this will come up when you go to small claims court. The buyer will make a point to tell this to the judge and the judge will address it.

My friend got a notice in the mail yesterday about the claim for the 220.00, and cant wait to give his side of the story, He has his threats in his email account, he even harassed and called his house numerous times. If your going to play the "poor me Im the victim role" don't threaten and harass the seller, he is around 40 years old and claims he was going to drive over to his house from states away, all I can say is he WILL not win his claim of 220.00 for his threats and harassment and could be facing a crime for what he has said. He has a chance to drop it if he wants, and if he were smart he would.

Sadly.... these will be two different issues in court. The judge will address them seperately. Your friend will have to pay back the money plus legal fees, and the buyer will most likely be fined for his harrassment and pay fees. If this is a matter of principle to the buyer, he will most likely carry it out just to prove a point and make your friend see the consequences of his actions.

Your right he does not own the rights to the gun but the design is slightly different than weta's and he wouldnt be using the term district 9 in the listing name so they really don't have control. It's almost like how china makes replicas or remakes of items just like official items.

And if they aren't, you can bet the person dupped out of their money has already printed this off and will be presenting the posts in court to show the copyright infringement...if not sending the posts to the copyright holder.

My prediction between the threats in emails, the posts, the admitted copyright infringment, and the $220.00 refund....... IT IS GONNA BE UGLY IN COURT!!:lol

That won't matter in the slightest, as a few members here have had their auctions and selling stopped from studios.

If people look at it and say "Wow a District 9 gun", then it is too close.
