Just a Caution on Dealing with jonesfx

I have been offering in the Junkyard first generation castings from the original mold used to make the Ghostbusters Gozer Temple door for the last couple of years. In that time, around 38 doors have been shipped and had no issue getting delivery. Well unfortunately it appears that one of the doors shipped may have gone missing. A door shipped to Paul Jones (jonesfx) seems to have not made it to him. Unfortunately, he chose to file a Paypal dispute before even contacting me to let me know there was anything wrong. For full disclosure, he sent an email a full 6 minutes before filing the Paypal dispute. Clearly, that's not enough time to communicate back to him prior to having done this.

The door was shipped and accepted (scanned by USPS) on March 1st. USPS tracking # CQ004996714US

Electronic Shipping Info Received, February 27, 2010

Right now a trace is being performed, but due to the typical practice of the USPS system after it was scanned in it was not scanned at any later time. Because my account was tied up with this dispute without any warning I went ahead and escalated it immediately and asked for the seller protection policy to be applied. With the seller protection it was my understanding that I would get refunded the money his dispute tied up and he'd get his money back. Even with the absolute proof of having shipped the item to him, they sided with him and he has now cost me $148 that I have to cover.

Also, due to the way Canadian post and US Post works, it's entirely possible it was delivered and then simply not scanned at destination. I don't know that this is the case, but I do know it is a fact that it was shipped and the evidence supports that.

As such, I highly recommend anyone dealing with jonesfx to require signature delivery on anything you ship to him. He won't even bother to try to work with you on the situation and instead will file an immediate Paypal dispute leaving your account with negative balances. The sad thing is, if he had bothered to contact me instead of filing an immediate dispute I would have been happy to ship a second door to him, this time requiring signature delivery. Due to dealing with him, I'm going to require it on every item I ship, regardless of the destination.

FYI: Paypal will always refund the buyer unless you show proof of delivery not just proof of shipping.

That's news to me, considering I've not received items before, there was no proof of delivery only an electronic submittal but no scan with acceptance by USPS.
 
unfortunatly its true, you may have proof of postage, but unless you get proof of delivery and aceptance, you havent got a leg to stand on.

its the sellers responsibility to ensure an item reaches the buyer, posting it and hoping for the best isnt enough in paypals eyes.

this happend to me once and it cost me dearly... now ill only post with full tracking and insurance
 
It's only been about a month, said item could easily still be in transit or stuck in customs since it appears you sent it regular parcel post... It's usually rare that it takes this much time but sometimes it does... Been there and done that many times over the years with packages easily taking over a month to arrive sometimes...

I personally just received a package back that I had sent to the UK last August, the buyer never paid the £17.09 VAT tax on it... Come Janurary 4th (4 months later) UK customs gives up trying to collect the VAT tax and returns/dispatches the package back to me... I didn't receive it back until March 19, a full 2 1/2 months after they posted it back to me, so in essence shipping time was about 2 1/2 months... Sometimes it's stupid crazy how slow things happen in the postal system...

And I feel your pain some buyers are just stupid when it comes to dealing with their sellers, I once had a guy purchase an item Friday night than come Sunday night he filed a dispute/claim that he never received the item, absurd since not one single business day had even passed yet...

And that's fair enough, if there was nothing received I'd have been willing to ship a second. Now he's got his refund he's not getting a thing from me.
 
I have always had trouble with Canadian shipping . SO much so I hate shipping and rarely do anymore. You can't get any judgement on shipping time from them. Something take a few weeks and some months. Good luck with it.
 
It's situations like this that remind me why I only ship UPS to Canada. That way I can at least show that UPS delivered the package.
 
This is very odd, because I knew Paul for many years and he was truly one of "us"... a VERY cool, easy-going fellow, who would give you the shirt off his back.

Looks like this could be sorted out with some good communication. I have never know him to be a "hard nose".

Yeah if you use the correct service with tracking and signature required, if you don't then it doesn't matter where you're sending it.
I had it happen to me years ago, i got a family member to post the item for me as they were heading into town anyway, unfortunately they sent it standard mail and the buyer claimed they never recieved it and paypal refunded them even though i had a reciept for shipping, that's how i found out they require proof of delivery not proof of shipping.
 
I've had my share of shipping woes to Canada. I will still ship there, however, I always let the receiving party know that if it doesn't arrive I will not be held responsible. Once they reply that they would like for me to ship anyway, I'll send the item. I just need an e-mail confirming that I won't be at fault.

That still won't stop PP refunding them.
 
I had a guy ask me if I would ship to Canada, and I had him email me a letter saying he accepts FULL responsibility if item gets lost or stolen, but I would follow all instructions of the buyer as far as shipping.

Ended up being filed in claim, and I wont because I showed the email to Paypal.

It makes me sad that people have such a bad time shipping to Canada. I buy tonnes of stuff and have never lost a thing. I'm one of the "good" ones, I don't mind waiting a month because I know sometimes that's how long it takes and as long as the seller keeps in communication I'm fine (and no, 6 mins isn't an acceptable response time to expect).

Problem is though... I *HATE* UPS and won't buy from anyone who only ships that way. I buy a $50 item and then they slap an extra $50 in fees on it in addition to whatever the sender paid in shipping. I don't know how they stay in business quite frankly. In Canada we have "Xpresspost" as a service from the post office which comes with a signature option that is much cheaper than using a place like UPS and doesn't have all the fees on the back end to discourage customers. Does the USPS not have something like this?

The problem is that USPS's default answer is that once it leaves the US that have no control and will not accept responsibility. Even if you send it signature required. They say it's up to the Canadian post to get the signature. And normally packages never get updated as delivered in the system. So the only option as a seller to be protected is to use FedEx or UPS. I know it really stinks for the people I sell to in Canada but I refuse to be burned anymore by shady buyers. Now, if it's someone I know and I've dealt with before I will send USPS. But someone new or someone on eBay. It always goes UPS.

It is worth a shot if you haven't already contacted them. Be humble and start your conversation with "I really need your help on this situation" or something similar. Most of the time the person on the other end will step up and be very helpful. Play the victim and beg if necessary. In the long run you will get your money back.

Only one party is going to get the money and in this case it's the buyer because it was their money and they never got the goods, paypal aren't going to refund the buyer and pay the seller.
 
For all this trouble you could have sculpted your own . All the ones I have seen up to this point look like they where sculpted by a 5 year old.

While we're not being helpful at all... I think the obvious answer is not to use Paypal. Seriously. I can see it for Ebay transactions, but anything else? I know... You have an account and it's "convenient". But then again, so is ripping you off by filing a fraudulent claim. Mmm... Convenience.

I gotta back Capn' up and say it works.
WHile I'm unsure if both parties would get paid, I know that making the call and pushing, albeit gently, works wonders.

I've done it many, many times. My M.O. is that I simply ask that person on teh other line how their day is, and take it from there. Those guys at Paypal have to wade through a truckload of crap each day.

I hate to say it though, but I'm betting this guy who's screwing Kerr is the same guy who'e recasting the door too,thus screwing him again. Grrr....
