AA case begins

If anything, the two helmets that TE owned have much closer ears to the originals than the SDS does. It's almost as though the SDS ears are a new sculpt entirely.

If I recall correctly it was stated by AA or a 'rep' of AA that the the "original" ear molds were gone or no longer salvageable so AA did sculpt new ones...
 
The comparisons are really interesting, but from a legal point, very pointless..
It really doesn't matter whether AA has the original plugs that the parts
were made from.. Even if he was the original Sculpter (which he wasn't) the
Copyright law will not come to his rescue.. Why?

AA has always taken the stance that lucas didn't have a contract with him,
but admits that he supplied Lucas with the countless Stormtrooper costumes
for the movie, clearly making this a "Work for Hire" case, in which the Employer
(George Lucas) becomes the Author of that work entitling him to all Copyright
Laws.. AA could be considered a Coauthor of the work if any legal documents
were drawn up with his signature, but I doubt that's the case here..

One could even argue that Brian Muir the original Sculptor has Copyrights
because he's the original artist, but because he worked for Lucas at the time
anything he created is classified a "Work for Hire" making Lucas the Author of
the work unless so stated in contracts..

AA can argue to the courts that he is the original creator all day long..
I don't believe he has much of a chance in this matter..

No his argument is it wasn't work for hire precisely because he wasn't contracted he was asked by a third party if he could make the stuff he made it and SOLD it to LFL no contract just invoices of SALE, therefore under law his design remains his own.
Brian Muir was under contract to LFL so that's different.

You don't buy a product from someone that is working for you, you pay them to make it that's work for hire.
 
Well speaking of Brian Muir he has made some interesting comments at the Propden, seems he isn't too happy that AA is trying to take credit for his work...

Because of this the only person possible was Nick Pemberton, unless something has emerged over the case. I know this may be irrelevant with regard to the court case but like many here, I'd like to truly understand the history of these characters.

Interesting photo analysis and compilation SL. Must have taken quite some time to gather all those pictures and put them together. :thumbsup
 
If you like those NoHumorman you will love these.:D Sithlord really loves to bury you with many pics showing absolutely nothing. It only takes a few to see the differences. I know its beating a dead horse but if Thomas can do it so can I.

Then there is the horribly inaccurate resculpted ear to compensate for the resculpted back cap.

Left 2 pics are AA's, the 3rd is molded from a screen used and the 4th is a screen helmet.

Notice how much longer the AA ears are. Then notice the angle on the leg of the AA.

Well, I agree partly ;)
A work made for hire can also be work that is commisioned or ordered from an
independent contractor, but Your right, a legal document must be drawn up
for the work. Hmmm and AA states that he signed not contracts..

In that case, Lucas better prove that Brian Muir was the original Artist :D
because it's already been established that AA produced the Costumes, So unless
they can prove BM the original artist, AA will have Copyright over everything
he's done for Lucas. Which will also allow him to make adaptations (changes)
to all the costumes as he wishes..

Ya know the funny thing is Copyright usually kicks in once a work of art is
complete.. AA never completed the Suits and Helmets, the artists for Lucas
did all the final paint detail. so that brings in another interesting point to this?????????????

Yep interested, any and all legal documentation is welcomed as I will add it to all the US legal documents I have compiled in one place for all to view...
 
I can't wait for the verdict. Lol I will say one thing about Sith Lords photo comparisons. I admit I never take the time to look through them. When I have presented forensic computer evidence in a case. I usually only present a few samples to drive home the point.
