Scammed by Ebay UK Seller Stuart "misterwaverley" Evans

A couple of months ago I purchased 2 screen used Riddick items from Ebay seller misterwaverley and paid a total of 501 GBP. Shipping would have cost a fortune (just as much as a plane ticket to London), so I asked if I could pick up the stuff myself later the year. I know now that this was pretty naive thinking of me, but the guy seemed completely legit, had (still has) 100% positive feedback and communication worked well.

A friend of mine moved to London and so I asked misterwaverley if he could ship (or bring) my props to him. This has been six weeks ago and since that time he didn´t reply to any of my E-Mails, which I sent him via Ebay, using his E-Mail address and the address from his PayPal Account. I can rule out the possibility that his computer broke down, he had no access to the internet, got ill, took a vacation or whatever since he bought stuff off of Ebay during that time and now even sells a couple of items...

If he would have had problems shipping to an unconfirmed address (as if that would matter after such a long time) he could have told me, but he simply ignored every E-Mail I sent him.

It obviously is much too late to use the usual Ebay or PayPal tools for such a case. Since the seller sold a lot of screen used props and costumes, maybe someone from the RPF knows this guy and can ask him what is going on. Any help or advice to solve the situation would be highly appreciated.

I still hope there is a good reason for the lack of communication, everything will work out fine in the end and I´ll be able to start a much happier post presenting my screen used Riddick props soon...

Misterwaverly is Stuart Evans who was quite well known amongst Doctor Who fans for his range of model kits released during the 80's and 90's, I have dealt with him in the past but that was nearly 7 years ago and I don't have any recent contact details. I do know that he often has his own stall at the memorabilia event in Birmingham ( he may do others, but that's the one I dealt with him at ), so if you have any friends who attend this then maybe they could ask him direct.

Since dano mentioned it I just added misterwaverley`s real name to the thread title.

misterwaverley currently sells Uniforms from the movie „Der Untergang/Downfall“. I would like to try to get his attention via the ask seller a question button from one of the auctions, but unfortunately the auctions are blocked for my german Ebay account since the word „Wehrmacht“ is included...

It's been over six months since I started this thread and guess what, I still don't have the goods I paid for. "Miraculously" shortly after I wrote about the issue here he responded after months without any communication on July 18th:

My Mums been very ill in hospital and thats taken absolute priority over my life.

Added to that the computer crashed about a month ago and its not been fixed until last week and I've only just recovered some of my emails.

Interesting how he was unable to reply to my E-Mails before due to a broken down computer while at the same time he had no problems buying on Ebay and even start new auctions. But since I couldn't rule out the possibility that his mother indeed was ill and I know how this affects your life I decided not to be an ass and told him everything was okay if he delivered the goods in the near future.

On July 24th he wrote another E-Mail and said that he would deliver the goods the next week. That's the last I've heard from him. Since October I'm trying to contact him via his two known E-Mail addresses and via Ebay on an almost daily basis, so unless he's dead there is no way for him to ignore that I'm still around. Even if his whole family is ill and his computer crashes constantly every week, how hard is it to take a minute and at least refund my money?!

I contacted "Consumer Direct" but all they did was give me some legal advice. Although 501 GBP is pretty much for me I guess it doesn't justify the costs for a lawyer...
 
Since I'll be in the UK this week I wanted to ask if I can simply print out the E-Mails concerning this case and take them to the police to press charges against Mr. Evans? This is the way I would have done it here in Germany, but I have no clue how it works in the UK and if it isn't too late for this anyway.

Call your insurance company and ask them if your "Rechtsschutzversicherung" might cover that.

Alternatively I´d suggest sending him one final email where you explain that you are coming to England, and if he doesn´t hand over the owed goods personally at a set date and time that you are going to take the matter to the nearest police station.

I don't have an insurance that would cover the costs for a lawyer in this case.

Sending him one final E-Mail would make sense if he actually read it, but since he didn't reply to anything I wrote him for almost a year now he obviously ignores my E-Mails.

Thanks to the advice of a very kind UK member here I will visit a London police station this week and see what happens after that.
 
I really hope you come to a solution with this. Be sure to keep us posted if everything works out in the end. I'd love to see what it was you paid for.

Hi there,

Here's another suggestion ... that is if you paid via a credit card. :confused
You can call your credit card company and ask them to resolve the matter for you. I once did. All they'll usually need is printed correspondance/emails between you and the seller and everything you can print from the actual ebay-auction if possible.

If you paid via a bank transfer you can also ask your Bank to assist you in getting your money back.

I've been to the police in London last Wednesday and reported this scam. I gave them every information I had and now will have to wait and see what happens.

The police didn't tell me how long it may take till they get back to me. I'll be home again in August (currently staying in Norway) and if I don't find a letter from the UK police in the mailbox then, I will call them to ask for the status.

By the way: The items I bought and paid for were a Working Hero Meccan Rifle and a complete Meccan Pilot Costume.
 
I found a letter from the Metropolitan Police when I came home from my vacation earlier this week: They closed my case since there is "not enough evidence to continue with further inquiries"...

Interesting since all communication with Stuart was done via E-Mail (therefore is well documented), I printed everything I had out and brought it with me when I went to the police, but the officer I talked to wasn't interested in it at all.

Looks like I wasn't the only one Stuart stole money from. smaff18 contacted me and Stuart owes him substantially more than he owes me. After buying from him via Ebay and having a perfectly fine transaction, he bought goods from him directly in 2008 that were never delivered and after the payment Mr. Evans simply ignored him. Unlike me smaff18 lives in the UK, but he didn't have any more luck than I had trying to get help from the police (and I thought I simply had bad luck talking to an incompetent officer...).

Good thing is that smaff18 has Stuarts complete address which he shared with me. If anyone lives near Trowbridge, Wiltshire and wants to pay this scammer a visit, I will gladly give you his full address if you PM me. smaff18 also gave me Stuart's mobile phone number but is not sure if it's still active, guess I'll try it in the next couple of days when my voice is back (damn cold).
