Redrawn copy of my Raiders map on Ebay...need advice

If a movie shows a blank page, they cannot claim to hold the copyright on whatever might be on the other side, especially when the original prop was four pieces of blank brown paper.

Based on my understanding, this map is a wholly original piece, other than the depiction of the Chachapoyan fertility god. The copyright's run out on that one. If they rise from their graves to enforce their copyright, we got other problems. :lol
 
The main issue is that the item is never shown in the film. Darth Saber created the artwork, and this seller copied it. Yes, they changed some stuff, but they clearly used his layout and design as the reference. Since he created the ficticious piece, he has the right to enforce Ebay to remove it.

Since it is pretty generic and NEVER EXISTED ON FILM, it does not infringe on copyright with LFL. I think we have established that..

And yes, we all know how we are infringing here in this community, and we wouldn't exist if we didn't!!

So please.... lets move this topic back to the original post about the seller and the Ebay issue and avoid this turning into a 30 page heated debate about recasting. We have enough threads in the past like that if you need to read:lol

I know I started this direction with my original question, and I am so sorry it has now gotten off track. I apologize, and with DS answer to me, he clarified what i needed to know and we should have just went back to the question in the first post.

TWo things... the seller might not know the map was copied from one here. The person who drew it might be the guilty one, and the seller just doesn't know.

The second thing.... the seller is taking the National treasure stuff and mass producing it. He clearly states on his MyProps page that he got it from someone else. So he is making copies and selling them. Unless the "ross" who gave it to him has granted him permission to copy it numerous times, then he is guilty of something.

I sent a vero claim to eBay this morning.
It should be removed within 24hrs.

It's gone now. :)

For me it was the symbol in the top left that pushed it over the line. You can argue about the mountain style and all that stuff but the top left medallion was a dead giveaway that this took more than merely inspiration from DS's map.
