Star Trek Discovery Phaser from MacFarlane Toys: dates and orange tip ?

Hello All:

From Wondercon 2018.. I asked a question re: MacFarlane Star Trek Phaser and was told:

a) Depending on where in the U.S.A. you live, the phaser shipped to you may or may not have an orange tip due to state toy gun laws..does anyone have confirmation of this ? which states are impacted by this ?

b) that this phaser will be available in the Fall (not Winter) of 2018...anyone have confirmation of this ?

From what I can tell, the orange tip on toy firearms is a federal regulation. I wonder if the federal regulation is loose enough to exclude the phaser, but then some states have stricter regulations.
 
The Art Asylum ENTERPRISE phase pistol I bought years ago, had an orange tip; I just masked and repainted it. Same with my TNG phaser from Playmates. Ridiculous, but nothing I couldn't deal with. :)

According to McFarlane customer service, this isn't their call, it is up to the distributor/store. Same inclusion in the ToyWiz Store ad. So somebody is BSing. Anovos doesn't have a problem shipping to customers who purchased their $500 prop copy, without the red tip.

It is a beautiful looking phaser minus the tip.
And "Yes" why can/will Anovos ship/produce a phaser without the orange tip while McFarlane wont?

I wonder if the orange coating will be easily removable with the correct finish underneath.
 
Anovos didn't make the mistake of labeling it a "replica firearm" or "replica weapon", but simply a movie prop replica. Semantics but it makes a difference.
 
This isn't new. I have seen toy catalog pages from the 1960s where it lists states, and cities where toy guns on the page can't be sold.
