Ebay problem and I am just wondering what some of you would

First, this is not a bitch thread... Here's the deal, I bid on and won gman666's P-2 bravo mask on 09/06/06. I understood in the listing that the bio would ship out at the end of the week. I paypal him immediately.

Then on the Sept 10th, I get this message from him...

"Thanks for bidding on my auction and congratulations on winning. As I stated all items would ship the following weekend after the auction ended. Due to unforeseen business trips, the items will not go out until after I return on Wed the 13th. The items are all boxed up and ready to go but I didn?t get back home until Saturday and the PO here was closed. I apologize for the delay and you can contact me at (999) 999-9999. I will have my phone with me but I will be in Canada so if you cannot reach me, leave a message. Again I am sorry for the inconvenience.

So on Friday, Sept 15th, still no bio, so I request his seller info from ebay and they send it. I call repeatedly and leave several messages and try to page him all to no avail. Finally I get a call back from him this past Sunday and he say's again that due to unforseen reasons, the bio has not yet shipped. But he assures me it will go out Monday Sept. 18th. During that phone conversation I asked him if he was a Lair member and he said he was. So I cut him so slack and emphathised and said OK just send it out and that was that, then this morning, Sept 20th, this arrived via email...

"You items are here and boxed up. I just have to make it to the Post Office to get them to deliver them. I am not doing this on purpose or to scam you. Why would I do that? If you feel that I am trying to make off with your money request a refund. All that I can say is that your items will go out as soon as I get home on Wednesday. Again if you think that I am scamming you go right ahead. The reason that I put in each description that the items would not go out till the following weekend is that I was to be home and able to send them out. That has not been the case as I am currently leaving for Detroit. I have made every attempt to get the items to the PO. I am single and have not been able to make it to a PO being on the road or stuck at work till after the PO closes. If I were in your case I would be pissed too. As in every one of my e-mails I am leaving my cell#. Call and if I don?t answer, leave a message."

I am sending this message to you along with the mass one I just sent out. I am incredibly sorry that your bio has not gone out yet. I have not been able to get to the PO. I am not trying to blow smoke but I really have not been able to get to a PO. I talked with you Sunday and I was telling the truth when I said that your bio was boxed up ready to go. I have had automotive trials the last 2 days that were not planned. I was pissed. My boss said that I could leave early today but I was stuck on the line from 6 this morning not leaving the plant until 6 tonight. I leave for Detroit first thing in the morning. This is the reason that I have been away from the Lair for the last 3 months. My screen name is gman666 and if you do a member search you will find me. I got into Predator with BatHunter, Mike, and Paul F a couple of years ago. I have had the pleasure of going to Paul's shop over in Knoxville and watching him work. I thought that I would be able to get back in the hobby but my job has shifted at Denso. I am now the Toyota guy going on all of the business trips. As I told you on the phone I just took a position that will have me going to Texas 2 weeks out of the month to launch the new Toyota Tundra plant in San Antonio. All a man has is his creditability and once that is gone he has nothing and I have lost that with you. I am not out to scam anyone. I have 13 other individuals waiting on their items also. I am trying everything but I live in BFE and their is one PO I have to make it to before 5. I do not have a 9-5 job, more like 6-6, and I have been trying to get out of work to make it there. If you want a refund I understand. I have been in the prop hobby for sometime and have heard all of the rip off stories. I even got ripped off on ebay last year for a bio. I believe that it was one of Paul's Porsche recasts. I am only assuming that since I never received it. The same individual tried to rip off several of us on the Lair.

My question is, what would you do in my shoes, please bear in mind that I have already asked for a Paypal refund from him and I have yet to receive a response. Am I wrong in thinking that it was irresponsible for him to list the items and not be able to ship them? How difficult is it to have the post office or UPS pick up from your location? What would you do? Am I wrong to think, enough is enough already. It's funny I don't own a bio, It's the only Pred item I don't have. And after hanging out with and seeing Streetjudge's sweet Bravo P2 I wanted one, Then I saw this one on ebay. If any of you know of anyone parting with a bio, P-1, 2 AVP or custom, please let me know. Thanks

All you can do is persue your refund via paypal. It seems you've been very patient. He could be telling you the truth but when it comes down to it, he has your money AND your bio. Not cool. There are many other sellers you could do business with, there is no need to tolerate these kinds of excuses. Good luck to both of you!
 
I've had a few EBay auctions that shipped out disturbingly late. In those instances, the promised shipping date is well passed. I understand that sometimes things happen that can alter plans or screw up a schedule.

But I cannot stress how important it is to follow through on a business contract. That's basically what an auction on EBay is. A business transaction that says "seller will provide this item to buyer once paid for".

In my Ebay selling past, I have never delayed any shipment beyond a couple of days past the payment date unless specific arrangements were otherwise. If I say that I'll ship it on such-and-such date, I do my best to meet that deadline. Your seller should not have listed the bio if he could not deliver it in a timely manner as promised.

When I am faced with a long wait after winning and paying for an item, I pay close attention to the elapsed time since payment was made. I check with seller every few days to see if my item has shipped yet. After 45 days, you have much more difficulty getting a refund for your purchase.

Hopefully, you will get your refund in a timely manner. If not, according to your info, you still have time to officially file with Paypal for your refund.

Feel sorry for ya man, and I do hope you get this Bio.


My pet peeve is ..I don't buy all the excuse ******** some people give you about not being able to ship an item. I have heard and have had it happen to me.

Can't the guy just ask a family member or even a neighbor to take the stuff to the PO. Hell, it isn't that hard to ask for someones help. Can't he have a co worker at the factory run to the PO during a lunch break.

There are many options that can be done to satisfy a customer,, but its always the easy one ( THE EXCUSE ) that seems to prevail.

To me its simple. If he can't follow up on his shipping obligations, then he has no right to be selling items he can't ship....PERIOD !
 
That sucks. It sounds like he lives in Canada so this might not apply since I do not know how their postal system works but here in the States you can schedule a pickup from the post office at your home or office so he could take it to work and have it picked up there. It sounds like he works for a large company, do they not have a shipping department that he can use? Plus if the post office is closed when he gets home and not open when he leaves for work can not he go to a non post office shipping center like Mail & More or Mailbox Express, they keep longer hours. If he really wants to get it shipped there are options to get it done, he just has to think of them. I’m sure he isn’t working 24/7.

He sounds sincere but then again 99% of the criminals out there will claim there innocent even if there is video of them committing the crime.
 
I will give the guy this...he sure does seem to be making an effort to at least comminucate with you fairly consistantly. It is very frustrating to wait on an item you paid for though. Keeping my fingers crossed for you to get this resolved quickly and easily. Let us know how it all turns out.
 
Well his credibility is completely shot. I've paged him at least seven times and emailed him three times requesting a refund. I have yet to hear back from him. Let me guess, they have no computers or cell phones, or his pager doesn't work in that area, or blah blah blah... I had no choice but to start a Paypal inquiry which sucks because now it will take like a month for me to get my money back. Now that I have had time to think about it, I'm pissed, he has my payment and the bio, when he realized it would be a problem to ship, he should have refunded me. The guy's excuses are totally pathetic and he is irresponsible. I hope you all have better luck!

Build up a few animatronic Stargate replicators and sic them on the slacker!!

But seriously, file for the refund thru Paypal. They always back up their buyers when this kind of crap happens.
