RECASTER ALERT: TIM GRAY ebay id timothyagray/spaceageprops

To be honest they would not interested unless hes making enough to actually pay taxes and under £500 a month I think is still classed as a hobby, but I might be wrong, otherwise 60-80% of sellers would have to dclare earnings from ebay - :(
 
To HMRC you are either in business or not, there is no hobby, if he hits the threshhold for tax he has to pay :). If he has a job + ebay he will be taxed on both and if he's unemployed Job Seekers would be very interested as you have to declare every penny. Most of ebay do need to declare income and HMRC often do random audits on ebay traders. :)

eBay and Paypal have set the minimum at 200 sales with $20,000 or more in revenue per tax period/year.
Once you reach BOTH of those requirements in a year, they automatically forward your records on to the tax departments.
 
The last thing we need is a witch hunt, this is all getting out of hand. I think the best solution is to let the mods find his ip address and ban him.
Whats the point of reporting him to authorities? by all means let Ebay know whats going on, let the staff here know too but I for one can't condone any other action.
After all, most of the items in this section are reproductions of copyrighted material anyway and regardless of whether or not profit is being made do we want HMRC or any other body looking too closely at anyone in here and the things they sell either from the paper prop forum or the junkyard?
I for one am not that sort of person and want no part in it whatsoever.
 
While I agree with what your saying I just have to point out that £100 may be pocket change to some but to others it can mean the difference between feeding your kids or not, please don't think I'm sticking up for this guy because I hate it when others steal peoples work, but no one knows why he has done this, perhaps he is struggling for work and needs any money he can get no matter how little.

All im im saying is shouldn't this be about the ethics of the situation not the money side of things? For example does it matter how much he is making, or is this about the fact that he has stolen others work and making money off them AT ALL?

I'm sure I'll get slated for saying any of this but I am the type of person that looks a little deeper into things than some, and am rarely impressed when people consider certain amounts of money as nothing. For instance I have been struggling for work for some time now due to the current economical climate as a lot of people are, and i am a father of two children with a house to run, and all I'm saying is unless you've been there you don't know how bad it can be and how desperate you become, as I say I'm not condoning recasting as I'd never stoop that low but some believe they have to do anything they can to survive.

The only thing I was trying to convey is that £100/month (but probably far less than that in actual profits) is a meager amount of money to risk your reputation and entire hobby for. I was just being cynical about the whole thing. Of course it wouldn't change anything if this guy made £500/month (but quite frankly I would understand the risk he took much better).

As for the reason why he is doing this, I don't think it's worth getting into that. Recasters are usually very good at explaining why they are profiting from someone else's work and it rarely has something to do with kids to feed. This is actually a generous community and people like Roland for instance helped members out on countless occasions (and sometimes got screwed in the process too) and doing this to them is just plain unacceptable.

yea we could all end up in a heap load of horse do-do if to many "authorities" look in to this forum, and I for one don't believe in reporting anyone to and government body, Ebay fine as is Etsy etc but the government or police, just opens up too many questions about you and why your reporting it and then they look at the forum and next thing you know we al get a "sorry but we've been shut down, due to copyright infringment" email and I for one dont want that, I love this forum and the people here, yes you too DD28 - Lol, and have some great friends from my time here, its good that we all look out for each other but let the originator deal with the issues after all it is there work and if they are not bothered then it should lie at that, I for one would be flattered if not a little anoyed but at the end of the day I did give the rop away for free and I suppose all rights to it as well, not sure if thats the legal standing my thats where I stand.

And it is that way of thinking that feeds these recasters. They count on that and know we will never truly stop them.
And what next? A seller in the JY scams 30 people to the tune of $15,000.00 in a run and again: "don't involve police or authorities because it will shine light on us here". Make no mistake, this community IS on the radar. Big studios who own the copyrights know about us and vigilantly watch us. They have contacted members before. They have C&D'd the site before to remove content and stop selling certain things. They choose to let things slide as long as it is done minimally. It really comes down to a fan run is ok, but start doing it so much that they see you are making it "your day job", they will put an end to it. The big dogs have flexed their muscles to the RPF about certain things in the past... But did they shut us down? No! They just let us know they are there and asked us to stop a certain action. Could they have gone further? Sure, but they choose not too. So stop worrying about the site going away, and we should concentrate on NOT LETTING THEIVES, SCAMMERS AND RECASTERS get away.

All of the items have been matched 100% to the items offered here for free.
He has lifted them all... Damn!
Even if he removes one or two items if the creators complain, he is still lifting stuff from here and judging by adding new stuff,
He is ramping to up to keep doing this as a business.

We need to shut him down here as well as on eBay.
 
The cold hard reality is there's not much can be done, yes the mods can find and ban him, but even with a free proxy and a new email addy he can get back in the very next minute and start posting to get access to the section again.
And unfortunately unless the items in question were clearly labelled 'NOT FOR RESALE' legally I doubt he can be stopped.
Even if they were labelled like that you'll need some pretty expensive lawyers in multiple countries to C&D his arse.
It's wrong and immoral to do what he's doing and I hate it but realistically how can we stop these people?
 
He might get stopped real easily if he PO the wrong person. Goes to his place with a knife/gun... the end.

Actually generally the rule is: If you made it, you own it.
People selling other people's property tend to get busted.

That could be the best way to combat him. If everyone buys an item, refuses to pay, and leaves negative feedback saying he is a thief, his score will plummet. The lower his score the less likely to sell. Also, by giving low star ratings, if he receives 3 or 4 in one review period, they will start holding funds from sales for 21 days. So another inconvenience. We need to start teaching these guys a lesson, and maybe that will get his attention.

The negative he recently got states that others are creating this art and he is just printing and selling it. It states that the art is free on the RPF.com.

And with eBay looking out for buyers over sellers, there are no consequences these days for non paying.
 
Alternatively,just report it to ebay that this guys a thief.That way they will try and stop him registering under another name.Let's not let one or two of these pirates spoil our hobby.:thumbsup

Ebay won't do a darn thing sadly.... Since we don't have this stuff copyrighted, they won't stop him because we basically don't have proof. We have tried that route before and it was a total bust. The only person successful was DARTH SABER who went as far as copyrighting his Raiders Map since it was never shown in the movie and it was conceived in his mind. So he copyrighted it and can pull the VERO card out to ebay and they usually remove the map from the guy. Other than that they just ignore the request. So we need to take this in our own hands at this stage.

I did just that and it knocked him down to 86,7%. And even if ebay forces me to pay (which I highly doubt) it's not like it's a lot of money anyways.
