"Recast" of my Indy Diary on eBay

One of my customers just pointed out this auction to me:

http://cgi.ebay.com/ws/eBayISAPI.dll?ViewI...em=270108366893

:angry This guy has taken my entire Indy Diary replica (which was entirely hand-written and drawn by me, with 98% invented text and pages) and reworked the text using a font while directly photocopying my original artwork. He's even using my original covers (which I sold him a while back to "make some blank diaries for he and his friends"). :rolleyes Guess I should have seen it coming.

You can see my original replica at my site: http://www.indyprops.com/pp-indydiary.htm

I've reported him to eBay. Hopefully his auction will get canned.

Kind regards,
Magnoli

Wow, this guy must be incredibly brave and/or stupid to post what is so obviously a knock-off your your unique product.

Sorry to see this happen to you Indy, but I'm glad someone brought it to your attention. I hope Ebay shuts this auction down soon. :thumbsup

Technically he's missrepresenting the auction description. You could contact ebay, give them the lowdown and have the auction removed under those pretenses.

Yeah, some of the inserts on the DVD as well as in his Grail Diary replica are mine as well. I did mention this to eBay as well, though since the auction isn't copying everything of mine, I doubt much will be done. But, as far as the Indy Diary is concerned, I'm going to hound eBay until it is closed. As BlueMirageStudio says, he's plainly lying in the description, so, in the least, I should be able to get them to do something about that.

Will keep you posted...

Kind regards,
Indy

I sent him this message:

"I have seen exact same replica on Indyprops.com. I think someone is not telling the complete truth about this replica. If you are making copies of this item need to remove this auction immediately that is called plagiarism. Please clarify what is going on or I will be forced to contact ebay my findings on this item. Also "This Indy Diary was created by me after months of researching." Credit needs to be given were credit is deserved."

Hope that will get his attention for you Indy.

:D Thanks for that. Anyone else feel motivated to send him a message... feel free. ;)

Kind regards,
Indy

This sucks, but what rights do you have? I mean you don't have a license to produce this I think? I wonder what eBay thinks...

It sucks though, that you can't make some great props, sell a few because people love the same thing as you and you make a few bucks to even invest more in the hobby anymore.

I do hope it gets pulled. And his account banned. He's making a lot of money with these.

Krikey, never have I seen a recaster be so vigilant in his plagiarism. Sorry to see this Indy.

What an @rse.

Digital recasting sucks. It seems that IJ paper props especially have a sad history of having ideas and designs appropriated by others.

I remember several years ago, one of the administrators here (RIP Wayne) came up with the idea to do a Indiana Jones passport, put together a prototype, got an interest list of potential buyers here, only to find out that someone else all of a sudden decided to take his idea and totally duplicate it to make a quick buck. The same thing happened with his Raiders diary and some Young Indiana Jones pieces that he and another member here put together. Apparently, the Young IJ stuff was duplicated identically and sold (unknowingly to it's creator) behind closed doors to others. It was pretty shameless, but it seems as though a lack of shame drives some people. While it's a sad situation, it doesn't seem as though there's much that can be done and this sort of nonsense isn't likely to stop any time soon.

Oh well. :unsure

Wow...I can't believe he even had the nerve to put that it was created by him after months of research.
Seems there should be more than just an E-bay law against something like that.

Well did you sell him an original?
[/b]

I think this is the one point you can make (which was entirely hand-written and drawn by me, with 98% invented text and pages.) 98% of the book has been created by you. If all else fails require him to remove the pages and text that you invented.... :D
