Question about prop websites/selling

I have loved reading the posts here for a while now and I am happy to finaily have something worth while to post. I am courious about websites you find that offer replica costumes or props, some of the people here have them. How can a non licensed person sell items on a website? For example there is a spandex costume site that sells superhero costumes but dont seem to have any problem with any of the liscense holders. I ahve also seen a few prop sites that do not seem to have a liscense so how can they offer stuff for sale? My friend and I are courious because we have been selling costume on ebay for quite a while and have been quite busy with it. Could we start a website? what are the do's and don's here on this matter? I would like any feedback on this subject. I really hope this does not turn into heated discussion as I have seen some like this on here, I would just like to know why some peopel can sell and others can not.

Usuall its because they are too small to be noticed/cared about by the license holders... but technically - yes, with a license it is illegal to sell things with licensed images or names. I BELIEVE thats the short version... but many people here know much more on the subject so there may be all kinds of "unless's" to throw in there...
