It's from Iron Man 2 (beard and haircut is really different from the style he sports in IM3).
If I had to make an educated guess I'll say unused underarmour suit concept.

Rhodey's suit does look more compact in the new poster, probly cuz it doesn't have Hammer's "bells & whistles" as Tony called it. Looking at the earlier pics, the MK8 looks almost matching size as the IP suit (besides a few cm taller)

I'm not liking the slimmer War Machine. I don't keep up with the books anymore but when Tony first made the armor it was bulky. It was loaded with weapons, hence the War Machine name. It just looks like another version of Iron Man armor.

Its real. The official Iron Man facebook page released it today. Just google image search "rhodes iron patriot" & the new poster pops up.

The Variable Threat Response Battlesuit was just another version of the Iron Man Armor. That's the one that was big and bulky, that's the one I fell in love with when I was a little kid. It's changed over the years and War Machine hasn't been in the spotlight (despite the film success) in a long time so there isn't really a "current" version to compare it with.

I'm okay with the body being sleek, but as I said like 10 or 15 pages back, the shoulder rails being so low-profile is what makes it look "wrong" to my eyes.

I thought WM was in the West Coast Avengers? I didn't think he still had a book. But figured he be in some Ultimate book. That's where his current look would be.

It's been so long since I read the books, I can't remember how the whole WM armor came about. I think it may have been when they took his tech and he rigged a IM suit with blood. He let them destroy it thinking he'd be gone.

actually in the ultimate universe tony uses the war machine himself. it was even in an animated movie

I think he used it originally when he made it. Then he had Rhodey use it since he was IM for while.

I've never seen the animated movies either.

yes that poster is a complete miss if your looking for menacing

It is an odd pose for a character who's usually depicted as regal and clean cut, but Kingsley may pull a Ledger and interpret the Mandarin in a way that will blow everyone's socks off. We'll just have to wait and see.
