Having real problems with a commission

I want it back mostly because in November of last year i had email correspondence with him, he was actually in another country at this time, i asked how he was getting on with the sculpt and he promised me that he would email me pictures within the week. That didnt happen and over the next 7 months he chose not to reply to any emails i sent him or Facebook messages. I know he was active because i could see it on his profile. So he was actively choosing to ignore my messages. He only responded to my messages once i emailed him asking for a refund and he admitted that it was the best course as he was swamped and was trying to work on many things at once specifying the new Star Trek film as one of the main reasons. Im just tired of the constant chasing and nagging i am having to do to get any updates with this commission. I fully expect that if i hadn't emailed asking for a refund this could possibly have beenn going many more years. At this point i honestly have no interest working with him

To be honest, Im surprised you had this much patience to begin with. 2 years is a long time.

Maybe you could Google his name and find out if he has a Facebook or Twitter account to see what he's been up to for the
last few months. You mention he lives in California.
Maybe in his free time he's been looking for work at local conventions that cater to his talents.
Or.....maybe he could just finish the original job.
Just a thought...

Hes on Facebook and Twitter. Not sure what he has been doing recently but i know around the end of last year and the beginning of this year he has been travelling around UK/Ireland and China i believe
 
I'd drop his name, if he's this shady who knows what he's been halfassing while on set or walking off with. There's enough folks on this site with connections that he'd at least be put on notice. Maybe there's a reason he's low on work.
 
Yeah with a little math I think I know who it is. I'm a little surprised. I would think not only that they were Busy, but paid well and be able to afford a refund.
 
wow $2700 and oover 2 years...how did you pay,,if by bank transfer is that some sort of online fraud,credit card do a charge back..paypal your time has run out..
personally this has gone on too long and would be consulting solicitors here in the uk,,you owe him no favors about this matter,,,
you paid for a job the money should be set aside till job is finished used only for for supplies..fingers crossed for you m8...

The guy in question is someone ive worked with. Typical story he is a good guy..... Seems the issue falls back on the ability to focus on an industry work project in a controlled shop environment vs a private commission on the side. Ive seen it many, many times with industry types looking to make a few dollars on the side. Starts out promising then a new big job comes in with deadlines which brings in more work that leads to yet another new production and deadlines... As an example I once worked 16 hour days, seven days a week, for six strait months only forcefully having to take off X-mas and Turkey day.

Its likely ill see mutual friends of the guy in question withing the next week. See what can happen.

As per anyone being nervous about commissions with people, always draw up a basic contract with time lines and include a receipt of payment sent from the person as part of that contract. Its simple stuff that shouldnt cause any issues with anyone. Contracts and deadlines are how things get done.

We are working on a new run of pulse rifles as we speak, so by time your payment plan is done, we will most likely be freshly stocked with a bunch.

We are doing another run of our stunt pulse rifle, that was based off of a stunt rifle used in the film. It is lighter weight and has no moving parts.

Oh right on that's awesome! Any chance in the future of doing anoyher run of functional PR's with aluminum shrouds and metal hardware ect?
 
Sad. Seen it many times.
Having been in the prop craft/hobby since 1978 I could tell you all sorts of accounts of people who do this and even feel justified.
Many times I have gone to attorneys and even the police because I had a very clearly understood agreement and the other guy decided to change it without asking. One was a guy I knew for 11 years.
I'd never pay for anything unless it was ready to ship the next day and also after seeing pictures of the actual specific piece I was going to get.

Possibly, but I am not sure. I know we are focusing on our Smart Gun, Flame Thrower, Stunt Pulse Rifle and Alien Motion Tracker right now.
