Working on a game for an indie film and wished to incorporate the symbol for the Necronimicon into the game marquee. This is a commonly used symbol and is recognizable. This is the Lovecraftian sigil on the cover of Simon's Necronomicon. I cannot find any information that the symbol is trademarked or copyrighted. Moreover, Simon's work is tauted as original derivation of ancient works. Not so much into the alternative religion's aspect of this but definitely wanted a Lovecraftian feel to the arcade game. The sigil is a combination of common symbols (pentagram, sigil of Malkuth, and the path of Jupiter I think- Thank you Wikipedia).
I am tempted to get a separate set of marquees and artwork done very quickly (start filming week Tuesday) if need be. Can anyone tell me when a symbol (which it is my understanding cannot be copyrighted) becomes a logo or trademark and how to figure this out?
